In April 2001 the Victorian Government passed the Health Records Act 2001 which:
Gives Victorians a legally enforceable right of access to their health information contained in records held in the private sector, and
Establishes eleven Health Privacy Principles (HPP’s) that will apply to personal health information collected, used and held in the public and private sectors.
Access to health information held in the public sector remains via Freedom of Information Laws. As of 1st July 2002, the Health Records Act is fully operational and the HPP’s will be legally binding.
